Penalty of 500 euros and removal of cameras by a jeweler after a neighboring café’s complaint..
We have been informed that a fine of 500 Euro has been imposed by the Administrative Court following a complaint filed with the Office of the Commissioner for the Protection of Personal Data from a Company acting as a cafeteria against a Company operating as a jeweler who adjoins the cafeteria and installed and maintained a closed circuit video surveillance (CCTV) on the outside.
The cameras, according to the complaint submitted, were installed in such a way as to inspect premises controlled by the cafeteria and to record every move and behavior of the owners / staff and the customers without their consent.
By the Decision dated 29/3/2019, the Administrative Court upheld the Decision of the Commissioner for the Protection of Personal Data of 10/3/2016 in the case.
In addition to a fine of 500 euros, the court also ordered the cameras to be removed and moved inside the jewelery shop.
The Court decided that the Commission acted within the legislation when required the above penalty for illegal installation of KKVP.
